Terms and Conditions
Eligibility:
1. 1M on Instagram Giveaway (hereinafter referred to as "Giveaway") is open to BURGA followers that followed @burgaofficial Instagram account before 08/04/2025.
2. Participants must be at least 18 years old or the legal age of majority in their jurisdiction of residence, whichever is higher.
3. Employees, contractors, and immediate family members of BURGA, its affiliates, subsidiaries, advertising and promotional agencies, and anyone connected with the Giveaway's production, distribution, or implementation are not eligible to participate.
Giveaway Period:
1. The Giveaway will start at 18:00 (GMT+2) on April 8, 2025, and will conclude at 18:00 (GMT+2) on April 15, 2025 ("Giveaway Period").
How to Enter:
1. To enter the Giveaway, Participants must be following @burgaofficial on Instagram.
2. To enter the Giveaway, Participants must like the Giveaway post on Instagram and tag a friend in the comments.
Prize:
1. The Winner will be announced by 18:00 (GMT+2) on 16/04/2025.
2. The Winner of the Giveaway will receive a set of three (3) BURGA products, consisting of one (1) phone case, one (1) drinkware item, and one (1) additional product, chosen from a selection of available items and limited to, Notebooks, Laptop Cases, Tablet cases, Earbuds Cases, Kindle Cases, Ring Holders, and Screen Protectors. The Winner may select the designs of their choice for each of the three products from the newest Collection (defined as a new release of BURGA prints and designs). This Prize will be awarded to the Winner for each new Collection released between April 15, 2025 and April 15, 2026.
3. The Prize does not cover newly released product categories.
Prize Claim:
1. To claim the initial Prize, the Winner must respond to our initial message on Instagram within one week of being contacted by the official BURGA profile.
2. To claim subsequent Prizes during the year, the Winner must reply to our email sent on the day of the relevant Collection launch from community@burga.com to the email address provided by the Winner during the claim of the initial Prize, within one week of us contacting them.
3. The Winner will be required to sign a Certificate of Acceptance and Transfer of the Prize before the Prize is dispatched.
4. The Prize will be shipped to the Winner within one month after confirming their selection, delivery details, and signing the Certificate of Acceptance and Transfer of the Prize. The Winner is solely responsible for providing accurate, complete, and up-to-date delivery information.
5. Prizes will only be shipped to destinations within the countries serviced by BURGA's delivery network.
Prize Disclaimer:
1. All Prizes are awarded "AS IS" and without warranty from BURGA of any kind, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose).
2. The Prize will be awarded if properly claimed. No substitution, cash redemption, or transfer of the right to receive any Prize or Prize component is permitted except at the discretion of BURGA.
3. BURGA reserves the right to substitute a Prize or Prize component of equal or greater value.
4. Winners are not permitted to request to change any Prize or Prize component with any other product.
6. The Prize consists only of the items expressly specified in these Terms and Conditions.
7. All expenses or costs associated with the acceptance or use of any Prize or any component thereof that are not expressly specified in these Terms and Conditions as being part of the Prize are the responsibility of the winner.
8. In no event will BURGA award more than one (1) Prize of each category mentioned in these Terms and Conditions.
Grant of Rights:
1. By claiming the Prize, the participant acknowledges that their name, handle, and any content included in their entry may be posted across any or all of BURGA's digital and social assets at BURGA's sole discretion.
Release and Limitation of Liability:
1. BURGA and its parent companies, affiliates, subsidiaries, agents, and licensees, and the officers, directors, owners, shareholders, employees, representatives, and agents of each of the foregoing are not responsible, and will have no liability for; (a) late, lost, delayed, illegible, damaged, corrupted, or incomplete entries, incorrect or inaccurate capture of, damage to, or loss of entries or entry information, or any other human or technical errors of any kind relating to the operation of the Giveaway, the communications or attempted communications with any participant, the submission, collection, storage, or processing of entries, or the administration of the Giveaway, (b) any Force Majeure Event or any other event outside their control that may cause any alteration, postponement, or cancellation of any part of the Giveaway or any prize; (c) undeliverable e-mails or entries resulting from any form of active or passive e-mail filtering by a user's Internet service provider and/or e-mail client or for insufficient space in a user's e-mail account to receive e-mail, or (d) any damage to any computer system or mobile device resulting from participation in or accessing or downloading information in connection with this Giveaway.
2. Released parties shall have no liability for any personal injury, death, property damage, or other damage or expense resulting from or arising out of any component of any prize or any other aspect of any Prize winner's use or misuse of the Prize.
3. By entering, each participant fully releases, covenants not to sue, and agrees to hold each of the Released Parties harmless from and against any and all claims and liability arising out of the operation of the Giveaway, participation in the Giveaway, the use of the BURGA Giveaway application and website, the acceptance, receipt or use (or misuse) of any Prize or Prize component, and/or any use of the participant's name, likeness, voice, and/or biographical information as permitted hereunder, including without limitation all claims and liabilities based on any personal injury, property damages, loss, and/or death.
4. Participants assume all liability for any injury or damage caused or claimed to be caused by participation in this Giveaway, the use of the BURGA Giveaway application and website, or the acceptance, receipt, or use of any prize or prize component.
5. The Released Parties are not responsible for any typographical, printing, production, or other error in the administration of the Giveaway or the announcement of any prize or notification of any winner.
6. The winner agrees to execute such additional release(s), waiver(s) of liability, and agreement(s) as may be required by a provider of a Prize component within the period specified by BURGA.
General Terms:
1. By participating in the Giveaway, Participants agree to abide by these Terms and Conditions.
2. BURGA reserves the right to disqualify any Participant who violates these Terms and Conditions or engages in any fraudulent or inappropriate conduct.
3. BURGA reserves the right to cancel, suspend, or modify the Giveaway in the event of unforeseen circumstances or technical issues that affect the fairness or integrity of the Giveaway at its sole discretion.
4. All decisions regarding the Giveaway, including winner selection, are final and binding.
5. Participants are responsible for any taxes or customs duties associated with the Prize and its delivery.
6. Any personal information collected from Participants will be used solely for the purpose of administering the Giveaway and will be handled in accordance with BURGA's Privacy Policy.
7. Participation in the Giveaway is voluntary and cannot be treated as coercion.
